Terms and Conditions

Achmem ("Seller") is committed to providing the chemical ("Product") or service as requested by the buyer ("Buyer") under the following terms and conditions. By placing a purchase order, the Buyer acknowledges and accepts these terms and conditions.

1. Price, Taxes & Other Charges

All prices are stated in U.S. dollars and are FOB Memphis, Tennessee. Please note that prices listed on achmem.com are subject to change without prior notice. However, rest assured that the shipment will still be promptly made, even in the event of nominal price increases. Any written quotations provided are guaranteed for a period of 30 days. All prices listed on achmem.com exclude any applicable sales tax, customs, or similar charges imposed by governmental authorities on the amounts payable by the Buyer. As the Buyer, it is your responsibility to bear all such taxes, customs, or any other charges levied by government authorities. Furthermore, the Buyer is also responsible for covering any wire transfer fees and similar bank payment charges, which should be settled at the time of payment for the invoiced amount.

2. Payment

The standard Terms of Sale require payment within 30 days from the invoice date, unless otherwise specified. Payments that are overdue will accrue interest at a rate of 15% per annum from the payment due date. The Seller retains the authority to request partial or full advance payment based on its discretion. Achmem gladly accepts payments in the form of checks, money orders, wire transfers, and credit cards.

3. Shipping & Returns

Upon receiving the chemical ("product"), the Buyer must promptly inspect it and notify the Seller of any shortages or damages within 7 days. Return shipments will not be accepted without prior authorization and shipping instructions. All items approved for return must be unused and in resalable condition. Please note that returned items may be subject to a 30% restocking charge and a $15 shipping cost. For any returns, the Buyer must include a copy of the Seller's invoice, the Seller's return authorization number, and provide a reason for the return. In the case of unqualified products, the Seller will offer free return or replacement as agreed.

4. Warranty and Patent Disclaimer

Unless otherwise specified in writing, the Seller provides a warranty that its products shall conform to the description as provided in the Seller's catalog at the time of shipment of the Products. However, there are no express or implied warranties regarding the fitness of these products for any particular purpose. The Seller does not make any warranty or representation concerning the Products' non-infringement of any letters patent or other industrial rights. The buyer assumes sole responsibility for any patent infringement that may arise from their use of our products.

5. Conditions for Use

Seller's products are intended for research and development laboratory use only and are not to be utilized for human application. Handling of all products should be restricted to competent, suitably trained individuals who are familiar with laboratory procedures and potential chemical hazards. The Buyer accepts full responsibility for the use, proper handling, and safe disposal of all compounds supplied, acknowledging that the Seller assumes no liability for any misuse or consequences resulting from such use.

6. Compliance with Laws and Regulations

This agreement, along with all matters related to its performance, shall be interpreted, applied, and governed in all respects by the laws of the State of Tennessee.
